「Chonky Penguin」 Pudgy Penguins Accused of Trademark Infringement by Classic Penguin Apparel Brand
BlockBeats News, March 6th, PEI Licensing, the parent company of the classic Penguin clothing brand Original Penguin, founded in 1955, officially sued the "Chubby Penguin" Pudgy Penguins Inc., accusing it of trademark infringement and brand devaluation. PEI stated that Pudgy Penguins used names such as "Pudgy Penguins," "Pengu Nation," "Forever Pudgy Penguins," and penguin-related logos on retail products such as clothing, hats, hoodies, and plush toys, which could easily lead consumers to mistakenly believe that the two are related. Although PEI had sent a cease and desist letter as early as October 2023, Pudgy Penguins continued to produce and sell related products.
Pudgy Penguins was originally a 2021 Ethereum NFT project, which later successfully transitioned to physical commercialization. Starting in 2023, it sold plush toys in large retailers such as Walmart and Target, achieving sales of over a million units in a short period and expanding into the clothing category. PEI is seeking compensation from the "Chubby Penguin" Pudgy Penguins for all infringing profits, its own losses, and other damages. Currently, Pudgy Penguins has not publicly responded to this lawsuit.
